Terms And Conditions
The following terms and conditions apply to the activities provided by Xtreme Off Road Limited (“the Operator”).
When we use the term ‘the Operator” we mean us or any of our employees, officers, agents and servants, owners and tenants of the private property used for any activity and their respective officials, servants, representatives, agents.
When we say “You” we mean you, your executors, administrators, next of kin, successors or assignees.
You acknowledge that travel with us, and the recreational services provided by the Operator, involve risk and whilst we make every effort to safeguard you, you acknowledge and agree that the Operator is not liable to you for personal injury, aggravation of any existing injury or condition, mental injury, contraction of any disease, loss (direct, indirect or consequential) or death resulting from the recreational services provided to you. Accordingly, the Operator excludes absolutely all such liability to you.
You agree these terms and conditions are exclusively governed by the laws and courts of New Zealand and agree not to commence any litigation or proceedings in any country in relation to the risks set out in the paragraph above. You indemnify the Operator against any such claims. In the event any such liability is attributed to the Operator, such liability is limited to the price paid by you to the Operator for the activity.
You agree that you are responsible for any damage incurred to the equipment provided by the Operator for self-drive activities and are liable for damage caused up to the value of $3,000. You authorise the Operator to use the credit card details provided to charge you with any such damage.
All departures and itineraries are subject to weather and may be changed or cancelled at the discretion of the Operator.
The Operator reserves the right to substitute vehicles without notice at any time and for any reason.
The Operator reserves the right to cancel any trip or reduce trip duration in any circumstances, including those which pose a safety risk to you, the vehicle or staff such as severe weather, including cyclones.
If the Operator cancels your booking prior to or on the scheduled departure date, you will be refunded within 7-14 days. The Operator will not be liable for any other loss you suffer as a result of any cancellation.
If the Operator reduces the duration of the trip due to unforeseen circumstances which includes but is not limited to inclement weather, any medical emergency such as injury to guests or crew or any other issue pertaining to the Operator, you may be offered a future trip at no cost to you dependent on the time remaining under your original booking and subject to any availability.
If you cancel your booking less than 36 hours prior to the scheduled departure you may forfeit the full trip price.
You may request a transfer of your booking, at our discretion, up to 36 hours before the scheduled departure. We reserve our right to charge you a transfer fee.
You will advise us of any medical conditions (including medications), disabilities or impairments that may affect your ability to participate in this activity safely. You consent to receive medical treatment in the case of injury, accident, illness during the activity and indemnify the Operator against any claims in respect of this treatment.
You will not participate in any activities whilst under the influence of intoxicating liquor or drugs (legal or otherwise) which may in any way impair your ability to undertake the activity.
We recommend you take out travel insurance.
